Terms and Condition

Welcome to Moorpark Tree Service, a fully licensed, bonded, and insured arborist company proudly serving Moorpark, CA, and nearby communities. These Terms and Conditions ("Terms") apply to all tree care services, including tree removal, trimming, pruning, stump grinding, emergency storm cleanup, and tree health assessments. By requesting a quote, booking service, or granting site access, you agree to be legally bound by these Terms.

1. Service Agreement

  • Estimates: All written quotes are valid for 30 days from issuance. Estimates are based on visual inspection and may be revised if on-site conditions vary (e.g., root damage, utility conflicts, access limitations).
  • Service Confirmation: Work begins only after signed approval, verbal confirmation, or deposit payment.
  • Scope Changes: Additional work requires a new written estimate and approval. On-site verbal requests may be billed immediately.

2. Pricing and Payment

  • All-Inclusive Rates: Prices cover labor, equipment, fuel, insurance, and standard debris removal unless otherwise noted.
  • Payment Terms:
  • Due upon completion unless pre-arranged.
  • Accepted: Cash, check, credit/debit cards, Zelle, Venmo, Apple Pay.
  • Deposits (up to 50%) required for jobs over $1,200 or custom materials.
  • Late Payments: Balances over 30 days accrue 1.5% monthly interest. We may file a mechanic’s lien for unpaid invoices.
  • Returned Checks: $35 processing fee.

3. Scheduling and Property Access

  • Time Windows: We provide 2–3 hour arrival windows. Delays due to weather, traffic, or prior jobs are not considered a breach.
  • Site Preparation: You must:
  • Clear vehicles, pets, toys, and obstacles.
  • Unlock gates and secure animals.
  • Mark private underground lines (e.g., sprinklers, lighting).
  • Public Utilities: We call 811 (USA North) before digging. You are responsible for private line locates.

4. Safety and Property Protection

  • Compliance: All work adheres to ANSI Z133 safety standards and Cal/OSHA regulations.
  • Protective Measures: We use mats, plywood, and careful rigging to minimize lawn and driveway impact. Minor rutting or sawdust is normal and not considered damage.
  • Undisclosed Risks: We are not liable for damage to hidden utilities, weak structures, or unstable trees not disclosed in advance.

5. Tree & Stump Services

  • Ownership & Permits: You confirm legal right to remove or prune trees. We can assist with city permits for an additional fee if requested.
  • Stump Grinding: Standard depth 6–10 inches below grade. Deeper or full root removal available at extra cost.
  • Debris Policy:
  • All brush and branches hauled away unless you request firewood (must be pre-approved).
  • Wood chips removed by default; can be left on-site upon request.

6. Cancellations and Weather

  • Free Cancellation: Up to 24 hours before scheduled start.
  • Same-Day Cancellation / No-Show: $150 minimum trip charge.
  • Weather Postponement: We may reschedule for safety during high winds, lightning, heavy rain, or wildfire risk. No charge to you.

7. Warranty and Limitations

  • Workmanship Warranty: 30 days from completion. We fix execution errors at no cost.
  • No Tree Health Guarantee: Survival after pruning, cabling, or treatment is not warranted.
  • Acts of Nature: Not liable for tree failure due to storms, drought, pests, or disease post-service.

8. Insurance and Liability

  • Full Coverage: $2M general liability + workers’ compensation. Certificates available upon request.
  • Disclosure Duty: Inform us of bees, power lines, unstable trees, or hazards. Failure to disclose may void coverage.
  • Damage Reports: Must be submitted within 48 hours of job completion.

9. Emergency Services

  • 24/7 Response: Available for storm damage and hazard trees.
  • Premium Pricing: After-hours, weekends, or high-risk jobs include urgency or hazard fees.
  • Storm Delays: Response times may vary during major weather events.

10. Governing Law & Disputes

  • California Law: All agreements governed by CA state law.
  • Venue: Disputes resolved in Ventura County courts.
  • Informal Resolution: We prioritize good-faith negotiation before legal action.

11. Changes to Terms

We may update these Terms at any time. The current version is posted on our website. Continued use of services after updates implies acceptance.
